1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers and business customers through our online store. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business is a natural or legal person, or a partnership with legal capacity, that acts in the course of its commercial or independent professional activity when entering into a legal transaction.

2. Contracting Parties and Conclusion of the Contract

The purchase agreement is concluded with Vincent Baumann Online-Marketing, Weiglpointer Straße 12, 83352 Altenmarkt, info@retroshapes.com. The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the “Buy” button, you are placing a binding order for the items in your shopping cart. Confirmation of receipt of your order will be sent via email immediately after the order is submitted.

3. Prices and Payment Terms

All prices listed are final prices, including VAT.

4. Delivery and Shipping

Your order will be delivered to the address you provided. Delivery times and shipping costs are listed in the product description. If any items are out of stock, we will notify you immediately.

5. Retention of Title

The goods remain our property until full payment has been received.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. For more details, please see our withdrawal policy.

7. Warranty and Liability

The statutory warranty rights apply.
We are liable for damages only in cases of willful misconduct or gross negligence. We are liable for slight negligence only in the event of a breach of a material contractual obligation (cardinal obligation).

8. Online Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform, which can be found at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

9. Final Provisions

If any provision of these Terms and Conditions is invalid, the remainder of the contract shall remain in full force and effect. The invalid provision shall be replaced by the applicable statutory provisions.
